POLO PARK HOMEOWNERS' ASSOCIATION, INC.

AMENDED AND RESTATED RULES AND REGULATIONS

 The following are the rules and regulations for the Polo Park Homeowners' Association, Inc.("Association").

A. Purpose of the Rules. The following rules and regulations are for the protection and benefit of all members of the Association and are imposed to insure safe and sanitary operation of the clubhouses, swimming pools and other recreational facilities and common areas in Polo Park (together sometimes referred to as "Recreational Areas” and /or “Recreational Facilities”.

B. Homeowners' Responsibilities. Your cooperation in abiding by these rules and regulations will afford pleasant relaxation and recreation for all concerned. Of course, all members and their families, guests, invitees, agents and contractors are required to observe all rules and regulations and to obey instructions of all employees and representatives of the Association.

GENERAL:

1. Inspect before use. All persons who use any portion of the Recreational Areas shall first inspect same and shall be deemed to have inspected and accepted the condition of same.

2. Use at own risk. All persons including guests using any portion of the Recreational Areas shall do so at own risk, and by use thereof shall waive, release and agree to indemnify, defend and hold harmless the Association, its officers, directors, employees, agents, successors and assigns, from and against all liabilities, deaths, losses, claims, judgments, fines, damages, costs and expenses.

3. Damaged to Common Property. If any common property is damaged, the cost to repair the property damaged shall at the option of the Association be (I) paid by the Association and then charged to the member(s) responsible for causing or permitting such damage (if known), or (II) directly charged by the Association to such members as the Association may determine.

4. Children. Children under sixteen (16) years of age must be supervised by an adult over the age of 18 during the entire time they are on, or using, any portion of the Recreational Areas.

5. Exclusive Use. The Association’s Board of Directors may, at its discretion, designate that a facility may be used exclusively by the participants or invitees of a private event or Association sponsored recreational activity.

 6. General Use. Member of the Association and their guests shall use the Recreational Areas in cooperation with other residents so that all persons will be able to utilize the Recreational Areas in turn.

7. Activities. No activities shall be initiated or sponsored by the Association, nor shall the Association's name be used, without prior approval from the Board activities liaison. A form for this purpose is available in the office. Furthermore, all activities shall be conducted as follows:

1. Description of Activity: The completed form must include, without limitation, an explanation of the purpose, time, place, equipment, and monetary requirements of the proposed activity.

2. Chairperson: A chairperson must be appointed by the members involved in the activity.

2. Funds:  If funds are collected, they must be turned into the office with proper paperwork. All cash received must be counted by two individuals. The signed cash count, along with any other funds received, must be submitted to the office the next business day and shall be deposited into designated accounts.

8. Exceptions. Group activities not directly affiliated with or sponsored by the Association and / or not using the Association's name or tax exemption number, shall be allowed solely at the discretion of the Board with prior written approval.

9.  Keys. Homeowners are provided with two Recreation Access Keys. The keys provide access to certain Recreational Areas such as the Clubhouses and Reading Rooms. Keys can be obtained from the office. Keys shall be returned to the office upon sale of the property.

1. Identification Bracelets. Homeowners are provided with six (two owner, four guest) bracelets. Additional bracelets for additional guests can be signed out at the office and returned when guests leave. Polo Park identification bracelets shall be displayed at all times when using the Recreational Areas. Bracelets shall be returned to the office upon sale of the property.

               2. Use of Keys and Bracelets. Keys and bracelets are for the sole use of Polo Park homeowners, residents, and their guests. Distributing keys or bracelets to persons not residing or visiting with a Polo Park homeowner or resident may result in the revocation of that homeowner’s or resident's right to use the Recreational Areas.

10.  Abusive Language. No abusive or profane language, bullying, or any other breach of the peace shall be permitted in the Recreational Areas or in any public portion of Polo Park.

1 Noise Levels. Any person wishing to use an audio device in the Recreational Areas or on any portion of Polo Park must keep the volume at reasonable level or use earphones.

2 Quiet time. The designated quiet hours, applicable to individuals, mechanical devices, and animals, shall be observed from 10:00 PM to 8:00 AM. The exception to these hours are for Golf Course maintenance personnel, who are authorized to commence preparatory activities required for the course's operational readiness by 6:00 AM.

11. Animals. Animals (including and without limitation domestic cats, dogs, birds, etc.) shall not be permitted in any of the Recreational Areas, including and without limitation the Golf Course and Veterans Memorial, except service animals, including and without limitation seeing-eye, hearing impaired, handicap assistance, and animals-in-training.

12. Pets. Homeowners are restricted to a maximum of 2 pets, any combination of dogs and cats. Pets must be restrained when outside and under the direct physical control of their owner. Aquarium fish, or small birds or other such common pets can be kept if in the HOA’s judgment do not present an unreasonable annoyance, hazard, nuisance, noise or interference with the quiet enjoyment of other property owners. Sustained noises from pets at any time is unacceptable. When walking your dogs, owners are responsible for picking up and disposing of any messes left by their pets according to the Florida Statute (posted on signs) pay a fine if proven it was your dog.

13. Maintaining Recreational Areas. Any person using any portion of the Recreational Areas shall be responsible for leaving the Recreational Areas in a clean and orderly condition including restrooms. Without limiting the foregoing, all papers, cigarettes, cigars and other waste matter and materials shall be deposited in proper receptacles. No waste matter is to be thrown or discarded into the pools or any other inappropriate place.

14. Alcoholic Beverages.  No alcohol shall be consumed in any public place within Polo Park including and without limitation any Recreational Areas, without prior written consent of the Board of Directors which may be withheld in its sole discretion. Persons under the influence of drugs or alcohol shall not be permitted on the Recreational Areas and shall not be permitted to use any amenities within Polo Park. Persons under the influence of alcohol will not be allowed in the Recreation Areas.

15. Residents' Responsibilities.  All members of the Association and residents of Polo Park shall be responsible for all actions of their families, guests, employees, invitees and assigns.

CLUBHOUSES AND COMMON AREAS

1. Purpose. The clubhouses and common areas shall be used primarily for functions planned by or for the enjoyment of Polo Park residents.

 2. Private Use.  Private events held in the clubhouses or common areas are permitted only at the discretion of the Board and only to Polo Park residents in good standing. No commercial use is permitted. Such use shall be based upon availability and coordinated with the Association's designated representative. A cash $200.00 usage fee and a cash $200.00 cleaning deposit must be received 2 business days before the event. The usage fee is non- refundable. The cleaning deposit may be refunded once the area has been cleaned and restored to its prior condition. If the association incurs additional expenses to clean or restore the area, the cleaning deposit shall be forfeited and additional charges will be incurred. The board reserves the right to change the usage fee, cleaning deposit, and other requirements from time to time as deemed necessary.

3. Responsibilities.  All persons shall observe all applicable laws and rules when they are in Polo Park, including without limitation laws and rules concerning smoking in any of the Recreational Areas.

4. Smoking.  Smoking and use of e-cigarettes and vaping are not permitted in the club houses, patio areas, pool areas or within 25 feet of buildings.

5. Operating hours.  Club houses are to closed from midnight to 6am or at other hours that may be set by the board.

PROPER ATTIRE IS REQUIRED WHEN PARTICIPATING IN POLO PARK GAMES AND ACTIVITIES.

Attire. Proper attire is required when participating in Polo Park games or activities. Shirts and appropriate footwear are required except within the pool area.

Equipment. All equipment must be cleaned and returned to its proper storage place after use.

 

POOLS:

1. Cleanliness.  All persons must shower before entering the pools.

2. Prohibitions. Running, wrestling, playing ball and other such activities which might disturb people in and around the pool area prohibited. Planned and scheduled water games are allowed. Smoking and e-cigarettes, vaping, chewing tobacco, or any other tobacco product are not permitted in the pool, pool deck, patio and sitting areas.

3. Infants. Infants and toddlers who are not "potty trained" must wear snug-fitting waterproof pants in or around the pools.

4. Safety. No toys, balls or Frisbee throwing, glassware, rafts and floats (excluding flotation devices, and dumbbells) are allowed in or around the pools. NO DIVING OR JUMPING in the pools.

5. Food and Drink. Rules posted within the pool areas pertaining to food and drink inside the fenced pool deck are to be obeyed. No glassware is allowed.

6. Pool Closures. The pool may be closed at any time by the Board or its representative for any reason, including and without limitation for repairs or inclement weather.

7. Hours of 0peration. Pools and the surrounding deck and sitting areas are closed from dusk until 8am unless otherwise posted. Changes of hours of operation for the pool shall be posted from time to time and observed by all members and guests.

8. Care of Property. All equipment and property of the Association (including and without limitation to patio umbrellas) shall be returned to the proper storage area or placed in a closed position after it is used. The Board reserves the right to limit use of equipment if it is not properly stored and maintained.

9. Animals. Animals are not allowed in the pool. Animals, other than service animals, are not permitted on the pool deck.

10. Not for Public Use. Pools are for use by Polo Park residents and their guests only. Children under 16 must be supervised by a resident or responsible adult.

11. Posted Signs.  All posted signs must be read and followed.

TENNIS COURTS / PICKLE BALL

1. Permitted Uses. The tennis courts are to be used for playing tennis and pickleball only, and for no other reason whatsoever, unless approved by the Board. Skateboards, bicycles, roller-skates, scooters, and similar equipment are not permitted. Animals, other than service animals, are not permitted.

2. Food and Drink: No food or glassware is permitted in the tennis court area except water in non-breakable containers. Sugary drinks are not allowed due to the potential damage to the courts.

3. Proper attire and footwear required: shirts must be worn. Proper court shoes are required. Sandals and slip on shoes are not permitted. For protection of the playing surface, black and dark colored soles on foot ware are not permitted.

4. Time Restrictions: The maximum two hours of playing time rule shall be observed, if others are waiting. Tennis and Pickleball courts are closed from 9 PM to 8 AM. Use of courts are allowed after hours with Board approval.

5. Not for Public Use. Courts are for use by Polo Park residents and their guests only. Children under 16 must be supervised by a resident or responsible adult.

6. Equipment. All equipment must be cleaned and returned to its proper storage place after use.

SHUFFLEBOARD COURTS:

1. Purpose. Shuffleboard courts are to be used for playing shuffleboard only and not for any other reason whatsoever.

2. Care of Courts. Walking on shuffleboard court surfaces is not permitted.

3. Food and Drink. No food or glassware is permitted in the shuffleboard court area except water in non-breakable containers. Sugary drinks are not allowed due to the potential damage to the courts.

4. Equipment. All equipment must be cleaned and returned to its proper storage place after use.

5. Not for Public Use. Courts are for use by Polo Park residents and their guests only. Children under 16 must be supervised by a resident or responsible adult.

PICNIC AREA:

1. The patio picnic area and horseshoe area are available for private use by residents for non-profit functions and the Polo Park horseshoe teams tournaments, scheduled through the activities Chairperson. The area must be cleaned immediately afterwards.

2. Equipment. All equipment must be cleaned and returned to its proper storage place after use.

GOLF COURSE:

1. Rules. The Board may impose or modify the rules from time to time.

2. Posted Rules. Those rules listed on the first tee regarding registration, proper attire, etc. shall be observed.

3. Golf Shoes: Golf shoes may only be worn on golf course and not in clubhouse.

4. Fishing and other uses: Fishing is not allowed on the golf course during hours between 7am and 7 pm. Association approved golf carts may be driven on the golf trails before 7am or after 7pm. Walking on the golf course or paths is only permitted before 7am and after 7pm.

5. Dogs: Walking dogs is not permitted on golf course or cart path at any time.

GOLF CARTS:

1. Association-approved electric golf carts are permitted on the golf course exclusively for the purpose of transporting golfers during designated golf hours. Authorized golf carts are either available for rental from the Pro Shop or constitute personal electric carts that have been preregistered with the Association.

2. Restrictions. Drivers of golf carts must possess a valid drivers license or be 18 years or older. Golf carts are restricted to proper roads, paths, and entrances and must not trespass on privately owned land. Drivers must observe all posted restrictions.

3. Registration. Golf carts, whether used on the golf course or on the community streets, must be registered at the Pro Shop and have the assigned numbers displayed on both sides of the cart.

 4. Rules. Drivers of golf carts are required to obey speed limits and other traffic laws.

 EXERCISE ROOM:

Rules for use of the room, equipment and the dress code are posted in the Exercise Room and must be followed. Machines are to be disinfected before and after each use.  All equipment must be returned to its proper storage area.

BOCCE COURTS: The bocce courts are for the sole purpose of playing bocce and not for any other reason. Proper care and treatment of the courts is required.

HORSESHOES:

1. Purpose. Horseshoe courts are for the sole purpose of playing the game of horseshoes and no other unless authorized by the Board.

2. Maintenance. The courts must be properly used and maintained. All equipment must be cleaned and returned to its proper storage.

BILLIARDS:

1. Purpose. Billiard tables must be used only for their intended purpose and for no other. Billiard tables may not be used for storage or for serving food or beverages.

2. Rules: Posted rules must be obeyed.

3. Maintenance. Care must be taken to ensure that the tables and equipment are not abused in any way.

4. Storage. Equipment must be properly cleaned and stored after use. Pool tables must be covered when not in use.

 COMPOUND, WOOD SHOP / RV STORAGE AREA

1. Smoking, vaping, e-cigarettes or use of any tobacco products is not permitted in this area.

 2. No items may be left outside the compound fence.

3. No tools or equipment may be borrowed or otherwise removed from the compound area, utility sheds and wood shop, etc. except for Polo Park employees in the course of their duties or Polo Park work volunteers serving the community.

Other Equipment: All equipment including, but not limited to ping pong tables, corn-hole games, shuffleboard and bocce equipment must be returned to its proper storage place after use.

Changing Rules and Regulations. The Board reserves the right to change, add to, and/or delete from these rules and regulations after having said change(s) recommended from a Polo Park committee. All changes shall be discussed at an open Board meeting prior to being voted on.

Homeowner Maintenance of Property.  The following is a list of what each homeowner is expected to maintain in order to keep our community aesthetically pleasing  and provide  proper paperwork to the office as per our governing documents:

Not submitting an ARC form for any and all exterior changes prior to starting project

Not completing and submitting Census form

Not submitting a rental agreement to office within 10 days of signing

Not registering and providing ID at office within 7 days of moving into Polo Park

Power wash house, trim, driveway

Paint house, trim, driveway

Remove weeds from landscaping and driveway

Keep grass mowed

Do not use carports as storage facilities

Fences may not be over 2 feet in height

Keep landscape shrubs and trees trimmed

Do not plant invasive bamboo

Keep ladders, tools, and wheelbarrows stored out of sight

Do not park on landscaping and yards

Pick up waste from you dog

Keep dogs on leash and under control whenever outside.

Non-compliance with any of the above may result in a fine of up to $50.00 per day up to a maximum of $1,000.00 or $50.00 per incident.
